The notarial activity revolves around three main legal areas of expertise: real estate, assets & estates and companies. The practice also advises on aspects of administrative law (urban, housing code ...), environmental law (questions of polluted soil, environmental permits ...), and judicial rights (declaration of unseizability, childcare conventions, seizure procedures ...). We pay particular attention to no-go areas and apply the rules of private international law to that effect.
In each of the domains described in more detail below, the legislation whether financial, federal or regional, is growing in importance (registration tax, inheritance tax, personal income tax ...). This is always taken into account to ensure maximum legal certainty for your operations to bring you the best solution for your situation.
Real estate
We will accompany you throughout the process of acquisition or sale of real estate. In doing so, we prepare your bids, your sales agreements and your deeds. Whether you are an individual or a corporation, we can also advise you on the best legal strategy for your acquisition or sale (joint purchase, separation of ownership, lifetime sales (viagère), sales where the Breyne law is applied, waiver of accession, creation of building leases, easements, long lease ...). We can act as required in the legal division of your building, whether vertical (subdivision act, notification division) or horizontal division.
Regarding the financing of your real estate projects, we prepare your acts for credit or mortgage mandates.
We can organize the public sale of your property with complete transparency, and with the appropriate impetus, and this with the assistance of the Chamber of Notaries (advertising, sales room ...). We can also safely organize an online auction via the internet platform biddit.be (only in French or Dutch), for maximizing your chances to find a buyer.
Asset and estate law
We assist you in all family life experiences (union, separation, death ...).
In this, we advise and draft the appropriate papers you’ll need for your cohabitation and prenuptial agreements, and change of matrimonial status. As an impartial public officer, we issue divorce agreements by mutual consent and can act in the division of your estate whether judicial or amicable.
We also work with you for all operations of estate planning whether donation, holographic or authentic wills, or use other techniques to better meet your requirements when it comes to civil law and tax law.
We accompany you during the loss of a loved one by relieving you of some of the formalities related to death, such as writing the certificate of inheritance or the establishment of the declaration of estate. We will ensure the correct and impartial sharing of assets and estates, in the best interests of all parties concerned.
Companies
We deal with all sorts of companies. We can take care of the drafting of the deed of incorporation, regardless of the form adopted, and any changes in the status (updates, increases and reductions of capital, creating different forms of shares, change in the corporate purpose ...).
We will also work with you in your company restructuring operations, be it a change of legal form or merger, demerger ...
